Choosing Your Business Name and Protecting It

Choose your business name by simply being creative, choose a name that stands out from the rest and conduct research to make sure that your name is not taken.  You also need to choose a business name that is a reflection of your brand identity and does not conflict with the  products and services that you are selling.  After you choose your name, there are 4 ways to register to protect your brand name. They are as follows:

 

The State Level- You can register to protect your business name at the state level which is called an entity name. Registering a legal entity name with your state depends upon your business structure and location. Protection of your brand name at the state level prohibits anyone other than you from operating a business under the same name. Since each state has different rules, you would need to check your individual state about protections at this level.

The Federal Level-Registering to protect your business name at the federal aka national level is called a trademark name. This protects your business name, products and services from being used by another (similar) business. The United States Patent and Trademark Office offers the opportunity for business owners to check business names, products and services against the national trademark database.

Doing Business As (DBA)– Also known as a trade or fictitious name. DBAs don’t offer legal protection, but do offer the choice for business owners to operate business under a name other than their personal name.  Having a DBA allows you to register for a EIN (Employer Identification Number) and a business bank account.

Domain Name– Also known as a website address or URL, you register to protect your business name online, which protects your domain name from being used by others. You would need to register your domain name with an accredited registrars directory to determine if your name is safe to use. Your domain name doesn’t have to be the same name as your legal business name, trademark, or DBA. For example, I could register my legal business name Virtu Works Fore U as the domain name Virtu Works Fore U Mompreneur.com
